This Policy specifically addresses our SMS processing activities. It supplements our general Privacy Policy and applies to situations where we act as a service provider or data processor on behalf of our Clients .
1. Our Role as a Service Provider
BulkBuys provides a technology platform that enables organizations to send and receive SMS messages. When processing messages on behalf of our Clients, we act as a “data processor.” Our Clients are the “data controllers” who determine how to use our services to communicate with their customers, employees, or other End Users. If you are an End User who has received a message from one of our Clients, you should refer to that specific organization’s privacy policy for information about how they handle your data .
2. Information We Collect
We collect information necessary to provide and improve our SMS services. The data we gather may include:
- Mobile Phone Number: The End User’s mobile number is essential for message delivery .
- Message Content: We process and temporarily store the content of SMS messages sent and received through our platform for the purpose of transmission, record-keeping, and quality assurance .
- Consent and Opt-Out Records: We maintain logs of opt-in consent and opt-out requests (e.g., “STOP” commands) to ensure compliance with regulations and carrier guidelines. This includes the date, time, and method of consent .
- Delivery Data: Information about whether messages were successfully delivered, read (if applicable), or failed .
- Technical Data: Limited device information, such as the mobile carrier associated with a phone number, obtained through our service providers .
- Account Information: Information about our Clients, including billing contacts and authorized users of our platform.

- Providing Services: To transmit SMS messages on behalf of our Clients, facilitate two-factor authentication, send notifications, and deliver other messaging services .
- Compliance and Legal Obligations: To comply with applicable laws, including the Telephone Consumer Protection Act (TCPA), 10DLC carrier guidelines (The Campaign Registry), and respond to lawful requests from government authorities .
- Operational Purposes: To maintain and improve our platform, troubleshoot issues, monitor for fraud or prohibited content, and provide customer support .
- Ensuring Consent: To verify that consent has been obtained by our Clients before messages are sent, as required by carriers .
4. Data Sharing and Disclosure
We are committed to protecting the privacy of phone numbers and opt-in data. We adhere to strict rules regarding data sharing:
- We Do Not Sell Data: We do not sell, rent, or share End Users’ phone numbers or SMS opt-in data with third parties for their own marketing purposes .
- SMS Opt-In Data is Protected: We do not share text messaging originator opt-in data or consent with any third parties for purposes unrelated to providing the SMS service .
We may share information with the following categories of recipients:
- Our Clients: Information collected about their End Users is processed on their behalf.
- Service Providers: We share information with telecommunications carriers, platform hosts, and technology vendors who assist us in delivering messages. These providers are bound by contractual obligations to protect your information .
- Legal Authorities: We may disclose information if required by law, legal process (e.g., subpoena), or to protect the rights, property, or safety of our company, our users, or the public .
- Business Transfers: In the event of a merger, acquisition, or sale of assets, user information may be transferred as a business asset .
5. Your Rights and Choices (Opt-Out)
If you are an End User receiving messages through our platform, you have control over your communication preferences.
- Opt-Out: You can opt out of receiving SMS messages from a specific sender at any time. To unsubscribe, simply reply “STOP” to any text message you receive. You may also see other keywords like “END,” “CANCEL,” or “UNSUBSCRIBE.” After opting out, you may receive a one-time confirmation message .
- Help: For assistance regarding messages you have received, reply “HELP” to the text, or contact the specific organization (Client) that sent the message directly. You may also contact us using the information in Section 11 .
- Data Subject Rights: Depending on your jurisdiction (e.g., if you are in the EU or California), you may have rights to access, correct, or delete your personal data. Because we are a processor, requests regarding data controlled by our Clients should be directed to the Client who sent you the message. We will cooperate with our Clients to fulfill such requests .
6. Message Frequency and Costs
- Frequency: The frequency of recurring messages varies depending on the specific program or campaign our Client has enrolled you in .
- Costs: Message and data rates may apply. Please consult your mobile service provider regarding any applicable fees .
7. Data Security
We implement reasonable and appropriate technical and organizational security measures to protect personal information from unauthorized access, disclosure, alteration, or destruction. These measures include secure data centers, encryption of data in transit, access controls, and regular security assessments. However, no method of transmission over the Internet or method of electronic storage is 100% secure .
8. Data Retention
We retain personal information only for as long as necessary to fulfill the purposes outlined in this Policy, unless a longer retention period is required or permitted by law. Message content and associated metadata are retained as needed for legal compliance, dispute resolution, and enforcement of our agreements .
9. Children’s Privacy
Our services are not intended for children. We do not knowingly collect personal information from children under the age of 13 (or the relevant age of consent in the applicable jurisdiction). If we become aware that we have inadvertently collected personal information from a child, we will take steps to delete it promptly .
